美谷律师参加上海市法学会民法学研究会全体成员大会暨“民法典•合同编”解释适用的疑难问题研讨会

    2019年12月15日，由上海市法学会民法学研究会主办，华东政法大学法律学院、华东政法大学民商法学科承办的上海市法学会民法学研究会全体成员大会暨“民法典·合同编”解释适用的疑难问题研讨会在华东政法大学长宁校区交谊楼召开。上海市法学会党组书记、会长崔亚东，上海市高级人民法院党组副书记、副院长、上海市法学会副会长茆荣华，华东政法大学党委书记郭为禄，浙江省法学会民法学研究会会长陈信勇，江苏省法学会民法学研究会副会长解亘，安徽省法学会民商法学研究会秘书长张红柳出席会议。自上海市法学会、上海市高级人民法院、上海市人民检察院、华东政法大学、复旦大学、上海交通大学、同济大学、上海财经大学、华东师范大学、上海大学、上海社科院、上海海事大学、上海对外经贸大学、南京大学、浙江大学等单位的专家学者和法律实务工作者等170余人参加了会议，美谷所执行主任项方亮律师作为上海市法学会民法研究会研究院参加此次会议。

    The meeting is chaired by Professor Jin Keke, Dean of the School of Law, East China University of Political Science and Law. At the start of the meeting, President Mao made a statement, he showed his appreciate for the trust of members of the Shanghai law society and the civil law society. What’s more, he extended a warm welcome to the leaders, guests and colleagues from the theory field and practice field of civil law in Shanghai.

    The seminar was divided into an opening ceremony and six specific units and the opening ceremony was chaired by President Mao. In this meeting, every specific unit had a different topic for discussion: The first unit mainly focuses on ‘the general principle of the contract part and the conclusion of contract’; The second-unit’s topic was ‘the validity of contract and implementation of contract’; ‘the maintenance,modification and transfer of contract’ was the subject of the third unit; The forth unit was focused on ‘the termination of contractual rights and obligations and the liability for breach of contract’.The fifth unit mainly focuses on "Famous Contracts of Factoring, Guarantee, Partnership, Property, etc." The sixth unit mainly focuses on the discussions of “factorless management and unjust enrichment”.In the end, Professor Jin made a closing summary, in which he believed that the seminar was focused, fruitful and successful.
