当美谷律师遇上骗子，人民警察是这么做的

2019年12月24日，我所汤佳主任手机上打来一个电话，没有细看的汤佳主任按下接听键。电话那头的人说着一口不甚流利的普通话，自称是警察，需要汤佳主任协助调查。

Director Tang was alert and when she peered the phone number carefully, she found that the number 0061894865343 belongs to Perth, western Australia. Could the Chinese police call from abroad to let Chinese citizen assist the investigation? Obviously, it’s a scam call. Director Tang had no intention of hanging out with a liar and hung up instantly. The whole proceeding lasted less than 30 seconds.
作为一名律师，对于这类的小儿科骗子行为轻而易举就能识破，但是为做一般的市民能否在这么短时间内做出有效的判断呢？这也是我们法律人一直担心的事情。

本以为只是一个小插曲，结果没想到的是，过了一个小时左右，汤佳主任接到真正的公安民警电话，说监测到境外诈骗电话打入并被接听，民警需要上门了解情况，并提醒千万别被骗子蒙骗。电话挂断，民警果然在半小时内赶到并了解情况，并就相应情况制做文书备案。
Director Tang would have thought it was just a episode but an hour later she got another call from the real police who claimed that they detected fraudulent calls coming in and being answered so that they needed to know the rope and warned not to be fooled by fraud. After half an hour, the police came to our firm and made documents for the record.
那么在了解电话诈骗行为之前，我们有必要先了解电话诈骗的性质。
So before understanding phone fraud,we need to understand the nature of phonefraud.一、电话诈骗是否构成刑事犯罪
Is phone fraud a criminal offense?
依据相关司法解释的规定，通过拨打电话的方式进行诈骗活动的，诈骗数额达到较大的，可以构成诈骗罪。《最高人民法院、最高人民检察院关于办理诈骗刑事案件具体应用法律若干问题的解释》
Interpretation of the Supreme People's Court and Supreme People's Procuratorate on Several Issues Concerning the Specific Application of Law in Handling Criminal Cases of Fraud
第一条诈骗公私财物价值三千元至一万元以上、三万元至十万元以上、五十万元以上的，应当分别认定为刑法第二百六十六条规定的“数额较大”、“数额巨大”、“数额特别巨大”。
各省、自治区、直辖市高级人民法院、人民检察院可以结合本地区经济社会发展状况，在前款规定的数额幅度内，共同研究确定本地区执行的具体数额标准，报最高人民法院、最高人民检察院备案。
第二条诈骗公私财物达到本解释第一条规定的数额标准，具有下列情形之一的，可以依照刑法第二百六十六条的规定酌情从严惩处：
(一) 通过发送短信、拨打电话或者利用互联网、广播电视、报刊杂志等发布虚假信息，对不特定多数人实施诈骗的;
第五条诈骗未遂，以数额巨大的财物为诈骗目标的，或者具有其他严重情节的，应当定罪处罚。
利用发送短信、拨打电话、互联网等电信技术手段对不特定多数人实施诈骗，诈骗数额难以查证，但具有下列情形之一的，应当认定为刑法第二百六十六条规定的“其他严重情节”，以诈骗罪(未遂)定罪处罚：
(一)发送诈骗信息五千条以上的;
(二)拨打诈骗电话五百人次以上的;
(三)诈骗手段恶劣、危害严重的。
实施前款规定行为，数量达到前款第
(一) 、(二)项规定标准十倍以上的，或者诈骗手段特别恶劣、危害特别严重的，应当认定为刑法第二百六十六条规定的“其他特别严重情节”，以诈骗罪(未遂)定罪处罚。

现在的骗子诈骗手法层出不穷，在我们的日常生活中，最常用的便是利用电话实施诈骗，同时犯罪分子普遍采用异地作案、异地诈骗、异地跨行取款，五花八门的电信诈骗手段让普通百姓防不胜防，其中主要包括：（1）电话欠费、（2）刷卡消费、（3）通知退款、 （4）虚假中奖、（5）低价购物（6）汇钱救急（7）PS图片（8）微信伪装身份……
遇到以上情况的市民朋友一定要三思而后行，别轻易相信对方，仔细查看电话号码,如果没有损失财物，可以报警给公安局备案。如果已经损失了财物，应当第一时间报警立案，并且联系银行、微信或者支付宝客服寻求帮助，积极配合警方协助破案，将不法分子绳之于法！
